

Judge Federico Moreno issued an order this week granting an injunction
preventing the judicial approval of a settlement agreement entered into between
CIGNA and a certain group of physicians included in a Illinois class action. The
order addressed Judge Moreno’s concern relative to the actions of CIGNA in
attempting to obtain an expedited settlement outside the jurisdiction of his
court and without bringing the matter before him in the multi district
litigation in Miami.

Re Managed Care
In an article that details Judge Moreno’s injunctive relief in In Re Managed Care, the Miami Herald addresses Judge Moreno’s “[l]ambasting Cigna for 'underhanded maneuvers.' As outlined in the article, Judge Moreno in Miami on Thursday ordered the health insurer “to stop a settlement reached with doctors in an Illinois court.” The article also detailed the 13-page opinion which was issued after the stock market closed in which Judge Moreno said he “cannot turn a blind eye to the underhanded maneuvers Cigna took to obtain this settlement agreement. Cigna snookered both this court and Judge [Patrick] Murphy in an obvious attempt to avoid this court's jurisdiction.''
