

The U. S. Supreme Court will consider only a specific issue about arbitration during the coming term. The review involves only two of more than a dozen insurance companies involved in the class action filed in Judge Federico Moreno’s court in the southern district of Florida. Harley Tropin, co-lead counsel with Archie Lamb for the physicians, called the development “…. a tempest in a teapot. The issues [that the court will hear] do not go to the heart of our cases,'' Tropin said. ``They address only certain claims against PacificCare and UnitedHealthcare, not our primary claims of conspiracy and aiding and abetting.'' A recent Fox News article noted that “[a]s big health insurers have dropped
coverage for unprofitable members and declined to compete by lowering prices in
recent quarters, they kept premiums and profits high.” The article also points
out that the rise in spite of early financial reports that suggest the pace of
underlying medical costs is abating for 2002.
